FCC Moves Ahead With Broadband Plan After Loss

Law360, New York (April 09, 2010, 3:40 PM ET) -- The Federal Communications Commission is pushing ahead with its national broadband plan despite a recent adverse appellate court decision regarding net neutrality.

FCC Chairman Julius Genachowski said Thursday that the ruling on Tuesday by the U.S. Court of Appeals for the District of Columbia Circuit does not change the commission's authority to achieve its broadband policy goals.

“The court did not question the FCC’s goals; it merely invalidated one technical, legal mechanism for broadband policy chosen by prior commissions,” Genachowski said.
