Law360, New York (June 02, 2011, 2:44 PM ET) -- A Montana federal judge on Wednesday rejected attempts to intervene by Idaho, the National Rifle Association and others in suits challenging a congressional rider requiring removal of Endangered Species Act protections for gray wolves in the northern Rocky Mountains.
Sixteen parties filed a total of five motions to intervene in two suits brought by environmental groups arguing the rider violates the constitutional separation of powers because it influences pending litigation without changing underlying law and provides that wolf delisting should not be subject to judicial review....
