Law360, New York (May 08, 2012, 7:17 PM ET) -- The California State Assembly on Monday passed a bill aimed at undoing a state appeals court decision by excluding overtime hours from fixed salaries for nonexempt workers, even if they signed a private employment deal covering all wages.
The Assembly passed A.B. 2103 — which would require that a fixed salary payment to a nonexempt employee include only regular hours, not overtime hours, even if the employee entered a contract with a company to the contrary — by a vote of 51-24.
