Law360, New York (September 17, 2012, 9:02 PM ET) -- A California appeals court on Friday revived a suit challenging the approval of a distribution facility for research laboratory supplier VWR International LLC by the city of Visalia, Calif., over concerns about the facility's environmental impact and the use of public funds for the project.
The trial court had ruled the suit was time-barred and that the plaintiffs — a labor union, three public interest organizations and an individual Visalia resident — did not have standing, but California's Fifth District Court of Appeal disagreed.
