Law360, New York (October 22, 2015, 11:42 AM EDT) -- On June 10, 2015, the U.S. Environmental Protection Agency proposed an endangerment finding as "a preliminary but necessary first step to begin to address greenhouse gas emissions from the aviation sector" under the Clean Air Act. The EPA also issued an advance notice of proposed rulemaking ("ANPR"), proposing domestic adoption of the forthcoming International Civil Aviation Organization ("ICAO") rules, which are expected in February 2016. The comment period closed Aug. 1, 2015. Not surprisingly, the aviation sector and environmental groups largely found themselves on opposite sides of the issue....
