Law360, Washington (November 21, 2011, 6:43 PM ET) -- An Ohio federal judge on Monday again shot down landscaper Brickman Group LLC's bid to nix a former branch manager's whistleblower suit alleging the company overcharged government real estate manager Duke Realty Corp.
In August, U.S. District Judge Michael R. Barrett rejected Brickman's argument that former employee Mark Elliot failed to state a claim when he blew the whistle on a regional manager, Mark Davis, for regularly telling employees to shirk contractual obligations in its landscaping services.
