11th Circ. Says Fla. City's Property Cleanup Wasn't Biased

Law360, Los Angeles (January 03, 2014, 6:20 PM ET) -- An Eleventh Circuit panel on Friday affirmed a lower court’s decision that the city of Fort Lauderdale did not violate the due process clause or the Fair Housing Act during a zero-tolerance campaign to reduce blight in a predominantly African-American area.

In an opinion written by District Judge Robert L. Hinkle, sitting by designation, the court ruled that while inspection reports issued to property owners describing violations erroneously stated that violations could lead to incarceration, the following notices were a “a paradigm of due process.”...
