Cable Subscribers Fight Dismissal Of Bundling Action

Law360, New York (November 02, 2009, 6:04 PM ET) -- A group of cable television subscribers is appealing the dismissal of a putative antitrust class action against a slew of major television programmers and cable providers — including NBC Universal Inc. and Comcast Corp. — that alleged the companies bundled programming and overcharged customers.

The subscribers filed a notice of appeal to the U.S. Court of Appeals for the Ninth Circuit on Friday, just three days after their third amended complaint was dismissed for failing to allege that the companies' conduct foreclosed competition in the market....
