SAP: Oracle's Evidence Preservation Motion Is Ploy

Law360, New York (May 01, 2007, 12:00 AM ET) -- Oracle Corp.’s motion asking for an order to preclude rival SAP AG from destroying “critical evidence” in Oracle’s suit accusing SAP of computerized theft is a ploy, an SAP executive said Tuesday.

“We think it’s for impact,” said Steve Bauer, SAP’s vice president of global communications, of the 10-page motion Oracle filed Monday.

Oracle’s motion seeks a court order requiring SAP to preserve evidence. Specifically, Oracle asked U.S. District Judge Edward M. Chen for an interim preservation order as well as an order compelling the parties...
