10th Circ. Nixes Claims That EMC Sold Faulty Products To US

Law360, New York (April 04, 2012, 5:28 PM ET) -- Two whistleblowers who worked at EMC Corp. failed Wednesday to persuade the Tenth Circuit to revive their lawsuit claiming the company knowingly sold defective data storage products to the federal government and caused "catastrophic" hardware failures at the U.S. Department of Defense.

The U.S. government had asked a Utah federal judge to throw out the suit before EMC was served with the complaint, saying it had already settled similar fraud allegations against EMC in an earlier filed suit brought by Jack Wade.
