9th Circ. Won't Revisit TV Bundling Case Against NBC, Others

Law360, New York (May 07, 2012, 3:59 PM ET) -- The Ninth Circuit on Friday refused to rehear before the full bench its March decision affirming the dismissal of a putative antitrust class action looking to force NBC Universal Inc., Comcast Corp. and other television providers to sell channels individually.

A three-judge panel voted unanimously to deny the plaintiffs’ motion for an en banc hearing. The plaintiffs had argued last month that the appeals court’s decision unfairly shielded content providers from antitrust scrutiny.
