9th Circ. Upholds Class Cert. In EDS Workers' OT Suit

Law360, New York (June 07, 2012, 4:04 PM ET) -- The Ninth Circuit on Thursday upheld class certification in a wage-and-hour suit against Electronic Data Systems Corp. in which it refused to let the company escape claims by one of the information technology workers, while tossing claims by two of the lead plaintiffs.

A three-judge panel affirmed as to plaintiffs David Heffelfinger and Andrew Hinds a summary judgment in favor of EDS that found there were no disputed issues of fact and that California database administrators, senior systems administrators, system engineers and information analysts for EDS...
