On Remand, 9th Circ. Preserves GPS Data In Pre-Jones Pot Case

Law360, New York (August 06, 2012, 9:16 PM ET) -- The Ninth Circuit on Monday declined to suppress evidence gathered from a GPS tracker federal agents placed on an Oregon man’s vehicle, saying they were following circuit precedent binding at the time, before the U.S. Supreme Court's Jones ruling precluded warrantless use of such devices.

A three-judge panel said plenty of other evidence gathered by U.S. Drug Enforcement Agency officers justified the 2007 stop of defendant Juan Pineda-Moreno’s sport utility vehicle, and that the data gleaned from the global positioning system devices was merely supplemental....
