10th Circ. Upholds FCC's Unbundling Order On Qwest

Law360, New York (August 06, 2012, 10:05 PM ET) -- The Tenth Circuit on Monday shot down Qwest Corp.'s bid to escape an order requiring it to comply with unbundling and dominant-carrier regulations in the Phoenix area, saying a Federal Communications Commission policy shift affecting the case was not grounds for approving the request.

A three-judge panel found that the FCC's change in requirements for communications companies seeking forbearance was reasonable.
