Law360, New York (April 18, 2014, 10:28 AM EDT) -- Since the Federal Trade Commission brought its first enforcement action involving a mobile app in 2011, the commission has actively brought cases against mobile app developers and, through such cases, has provided numerous examples of the types of practices it considers "unfair" or "deceptive" under its Section 5 authority. With the agency's increasing focus on privacy and information security — in particular how these concepts apply to mobile products and the "Internet of Things," companies would be wise to ensure careful evaluation of the types of information collected by their mobile offerings. Companies should determine whether their devices transmit information securely and confirm that all representations about their products — including as applied to the usage and security of consumer information through privacy policies, in-app representations or otherwise — accurately reflect the company's practices....
