Law360, New York (May 06, 2009, 12:00 AM ET) -- Utica Mutual Insurance Co. has added claims to its lawsuit seeking judgment that it doesn't have to indemnify Rohm and Haas Co. and Morton International Inc. in four groups of lawsuits related to allegations of exposure to toxic materials and the cleanup of a contaminated landfill.
In its amended complaint, filed Wednesday in the U.S. District Court for the Eastern District of Pennsylvania, Utica added claims of unjust enrichment, mistake of fact and breach of implied agreement to amend contracts to permit reimbursement for unobligated payments....
