Entergy Sued Over Sales To Unaffiliated Marketers

Law360, New York (July 10, 2009, 12:00 AM ET) -- The Louisiana Public Service Commission has accused Entergy Corp. of profiteering at consumers’ expense, alleging the company's Arkansas utility has been selling low-cost electric energy intended for system affiliates to third-party power marketers, including Duke Energy Corp. and Westar Energy Inc.

The LPSC formally lodged its complaint with the Federal Energy Regulatory Commission on June 29, claiming that Entergy Arkansas Inc. has routinely violated the terms of the system agreement and boosted shareholder profits by selling energy allocated for system use to unaffiliated power marketers, forcing...
