Law360, Los Angeles (September 26, 2011, 6:32 PM ET) -- Energy equipment maker Lufkin Industries Inc. asked the U.S. Supreme Court earlier this month to review a Fifth Circuit decision denying its request to decertify an employee class alleging racial discrimination, based on the Wal-Mart Stores Inc. v. Dukes decision.
Lufkin filed a petition for a writ of certiorari with the Supreme Court on Sept. 16, arguing that a multimillion-dollar class action verdict against the company should be reversed on grounds that the plaintiff class should never have been certified in the first place.
