5th Circ. Upholds Choice Of Law In Chopper Crash Suit

Law360, New York (February 03, 2012, 5:41 PM ET) -- The Fifth Circuit on Thursday upheld a ruling that Louisiana, rather than Florida law, applied to a lawsuit brought by the parents of one of eight people killed in a 2009 helicopter crash — a choice-of-law determination that doomed the suit.

The lower court had dismissed the lawsuit because Louisiana law does not permit a wrongful death claim by a decedent's parent when that decedent is survived by a child, as was the case with helicopter crash victim Charles Nelson III, a Florida resident. The action...
