Law360, New York (March 17, 2008, 12:00 AM ET) -- The U.S. Supreme Court has denied a petition for writ of certiorari filed by the New York Mercantile Exchange Inc., affirming an appellate court’s ruling that Nymex’s settlement prices for oil and gas futures cannot be copyrighted.
After considering the petition at a hearing last week, the high court ruled Monday to deny cert, putting the last nail in the coffin of a long-standing copyright and trademark infringement dispute between Nymex and rival commodity exchange IntercontinentalExchange Inc.
