Law360, New York (August 10, 2012, 7:59 PM ET) -- Former judges and federal prosecutors urged the U.S. Supreme Court on Friday to overturn an Eleventh Circuit ruling that vacated sanctions against government attorneys accused of misconduct in a case where a physician was acquitted of illegally distributing pharmaceuticals.
The brief, which was also signed by members of Congress, asserts that the Eleventh Circuit's ruling implies that prosecutorial misconduct will generally be overlooked as long as the actual charges have probable cause.
