The Ninth Circuit on Monday threatened to toss out continued attempts to remove the judge overseeing the massive antitrust lawsuit accusing Apple Inc. and other tech giants of illegally agreeing not to poach engineers, telling the would-be intervenor, whose original bid was found to have been falsely filed, to pay for his appeal.
