The Sixth Circuit backed the dismissal of a suit from a machinist who said she was fired for taking time off to manage her HIV diagnosis, ruling Thursday that she hadn't shown the manufacturer she worked for terminated her because of disability bias rather than absenteeism and poor work.

An Ohio magistrate judge on Tuesday recommended tossing out a quarter of an HIV-positive former Meyer Tool Inc. machine operator's wage and disability discrimination suit, saying claims for gender bias and wrongful termination weren't up to snuff.
