    A mariners union has urged a federal judge to reject a shipper's bid to toss a lawsuit over an arbitrator's appointment in a labor dispute, saying the company's arguments are outside the scope of the D.C. Circuit's earlier remand.

    DC Circ. Says Labor Arbitrator Couldn't OK Own Selection

    The D.C. Circuit on Tuesday vacated a district court decision making a maritime union arbitrate a labor dispute with shipper Liberty Maritime Corp., saying the court, and not the arbitrator, should have decided whether the arbitrator was validly appointed under their collective bargaining agreement.
