The D.C. Circuit on Friday rejected a bid by rail workers' unions seeking to invalidate a Federal Railroad Administration final rule concerning freight railroads' risk reduction programs, saying the agency might have slow-walked the rulemaking process, but had still done its due diligence.

The D.C. Circuit seemed wary Tuesday that it could vacate a challenged Federal Railroad Administration rule on risk reduction programs just because the agency missed the one-year deadline that Congress gave it for handing down rules.

The U.S. Department of Transportation has fired back at a bid by rail workers' unions to get the D.C. Circuit to invalidate a February final rule clarifying what freight railroads must include in their risk reduction programs, saying worker safety concerns were fully vetted.
