The Ninth Circuit shouldn't revive a worker's suit seeking coverage from his former company's insurers over a $4.9 million settlement he reached with the company's directors and officers, the insurers said Friday, arguing that two exclusions apply including one for violations of employment laws.

A laid-off worker at a now-bankrupt solar power company asked the Ninth Circuit to revive an action seeking coverage from the company's insurers, saying an employment exclusion does not apply to breach of fiduciary duty and tort claims asserted against former directors and officers.
