A North American liquid storage company asked a New Jersey federal judge to toss a lawsuit filed by the United Steelworkers seeking additional back pay for a rehired worker, saying the employee isn't owed the money and the union sued too late.

A bulk liquid storage company failed to provide overtime back pay to a worker who was reinstated after an arbitrator ruled he was unjustly fired and owed pay for the duration of his termination, according to a lawsuit his union filed in New Jersey federal court.
