The U.S. Department of Labor urged a Pennsylvania federal court not to toss its Fair Labor Standards Act retaliation suit against a nursing home, arguing Monday that the statute protects even ex-workers from actions that might dissuade workers from participating in protected activity.

A Pennsylvania nursing home retaliated against a former employee by suing her when she was scheduled to testify at trial in a wage case that the U.S. Department of Labor brought against the nursing home, the agency said in a lawsuit in Pennsylvania federal court.
