The U.S. Department of Health and Human Services on Monday urged a federal judge to dismiss a suit brought by Texas over an Obama-era rule prohibiting recipients of adoption-related federal funding from discriminating based on gender and sexual orientation, writing that the legal issues of the case were already decided in a previous challenge to the rule.

Texas challenged an Obama-era rule that forbids recipients of adoption-related federal funding from discriminating on the basis of gender identity, sexual orientation, and same-sex marriage status, claiming Monday it could force the state to choose between receiving federal funding or working with certain religiously-affiliated adoption groups.
