A former bank compliance officer asked the Eleventh Circuit Monday to drop her bid to revive an age and gender discrimination lawsuit against her former employer over issues related to the disqualification of Freeman Mathis & Gary LLP in the case, following a settlement between the parties.

The fact that a later-disqualified Freeman Mathis legal team filed a motion that led to summary judgment is not grounds to revive a bank compliance officer's age and gender discrimination suit, as the issue wasn't raised with the trial court, the Geo D. Warthen Bank argued to the Eleventh Circuit on Wednesday.

A former bank compliance officer told the Eleventh Circuit a Georgia federal judge wrongly ended her sex and age bias suit against the bank by ruling on a motion the bank's law firm filed before it was disqualified from the case because one of the woman's attorneys had joined the firm.
