ORDER granting 21 Letter Motion for Extension of Time to Answer re 21 FIRST LETTER MOTION for Extension of Time to File Answer from Bryan Carr Olert dated May 13, 2024. Before the Court is Defendant City of New York's Letter Motion for Extension of Time to File Answer (the "Motion"). (ECF No. 21). Federal Rule of Civil Procedure 16(b)(4) states that the schedule set in a civil action may be modified only for good cause and with the judge's consent. Fed. R. Civ. P. 16(b)(4). The Motion is Defendants' first request for an extension of time to respond to the Complaint, and counsel states that the requested additional time is necessary to determine whether Defendants Kevin Perdomo and Denise Turner qualify for representation by the City of New York Law Department under New York General Municipal Law § 50-k. (ECF 21). The Court finds that this constitutes good cause to grant the relief requested. Consequently, the Motion is GRANTED, and Defendants shall respond to the Complaint by June 28, 2024. If the City of New York Law Department determines it cannot represent Defendants Perdomo or Turner, it must notify the Court of as much by that date. Defendant City of New York shall promptly serve a copy of this Order on Mr. Willis and file proof of service on the docket by May 16, 2024. The Clerk of Court is respectfully directed to close ECF No. 21 and to mail a copy of this Order to Mr. Willis. City of New York answer due 6/28/2024 (Signed by Magistrate Judge Sarah L.
