MINUTE entry before the Honorable Beth W. Jantz: Plaintiff's opposed motion for leave to file a reply brief to the motion to compel 132 is granted. Plaintiff may file a reply brief not to exceed 5 pages by 5/9/24. Plaintiff also alleges that Defendant's Response is "comprised of eight (8) cherry-picked pages of testimony from Plaintiff's deposition transcript." To the extent that Plaintiff wishes to refer to deposition testimony in the reply, Plaintiff must include pin cites for the refenced testimony as well as attach it as an exhibit. However, to the extent that Plaintiff is now challenging the use of Exhibits 1 and 2 to Defendant's brief in response to the motion to compel [Dkt. 130-1 and 130-2] pursuant to FRCP 37(c)(1) (Plaintiff alleges that Defendant impermissibly withheld them from discovery), that argument should be presented in a separate motion (not to exceed 10 pages, and with specific reference to what discovery request(s) called for their disclosure), also due by 5/9/24. Defendant's brief in response (not to exceed 10 pages) to any FRCP 37(c)(1) motion shall be due by 5/16/24.
