ORDER and OPINION. Plaintiffs Complaint is DISMISSED without prejudice. As a result, Plaintiffs remaining motions (Docs. 5, 6) are DENIED as moot. Although it appears that Plaintiff may not state a claim under these facts, out of an abundance of caution, he will be given an opportunity to file an amended complaint within 30 days.
