Order Dismissing Case
ORDER. By Order dated December 14, 2023, the Honorable Robert M. Levy directed Plaintiff to either pay the filing fee or complete an IFP application that explains his financial circumstances, in support of his claim that he is unable to pay the filing fee. Magistrate Judge Levy warned Plaintiff that if he did not submit a completed application to proceed IFP or remit the filing fee within 14 days, then the action was subject to dismissal without prejudice. More than 14 days have elapsed, and Plaintiff has not responded to the court's Order. Accordingly, Plaintiff's complaint is dismissed without prejudice. The Court certifies pursuant to 28 U.S.C. § 1915(a)(3) that any appeal would not be taken in good faith and therefore in forma pauperis status is denied for purpose of an appeal. Coppedge v. United States, 269 U.S. 438, 444-45 (1962). The Clerk of Court is requested to send a copy of this Order to Plaintiff and note the mailing on the docket. Ordered by Judge Eric R. Order on Motion for Leave to Proceed In Forma Pauperis
ORDER denying 2 Motion for Leave to Proceed in forma pauperis. Based on incomplete and implausible information, I am unable to find that Plaintiff is entitled to proceed IFP. Accordingly, Plaintiff must complete the attached IFP application or pay the $402 filing fee to the Clerk of Court of the Eastern District of New York within 14 days from the date of this Order. If Plaintiff fails either to submit a completed application to proceed IFP or to remit the filing fee within the time allowed, I will recommend that the action be dismissed without prejudice. Should Plaintiff wish to proceed with this action, he must also provide a service address for the Defendant. The Clerk of Court is requested to send a copy of this order to Plaintiff, along with the IFP application. Ordered by Magistrate Judge Robert M. Levy on 12/14/2023.
