Order Dismissing Case
ORDER DISMISSING CASE: For purposes of establishing federal diversity jurisdiction, the citizenship of a limited liability company or limited partnership is determined by the citizenship of its members. See Americold Realty Trust v. Conagra Foods, Inc., 136 S. Ct. 1012, 1015 (2016) (discussing the rule as applied to limited partnerships); Handelsman v. Bedford Village Assocs. Ltd. Partnership, 213 F.3d 48, 51-52 (2d Cir. 2000) (discussing the rule as applied to limited liability corporations). In response to the Court's order to show cause (Doc. # 28 ), defendants submitted an affidavit (Doc. # 36 ) indicating that more than one of defendants' members are citizens of the state of Connecticut. Plaintiffs do not dispute this representation, and yesterday emailed the Court to confirm that one of defendants' parent companies is a Connecticut registered corporation. Because at least one plaintiff is also a resident of Connecticut, and in the absence of objection from the parties, this case is therefore DISMISSED without prejudice for lack of complete diversity. See, e.g., Marks Group, LLC v. Schiciano, 2011 WL 6816552, at *4 (D. Conn. 2011).
