Order on Motion for Pre Motion Conference
ORDER: Upon reviewing the parties' 98 99 100 101 submissions, the Court denies Defendant Interim Healthcare, Inc.'s ("Interim") and Plaintiff Community Care Companions, Inc. and Third-Party Defendants Alexander Caro and Mark Gatien's (collectively, the "Community Care Parties") 98 99 pre-motion conference requests as unnecessary. The Court sets the following briefing schedule for the parties' motions: (1) Interim shall file a single, omnibus brief, not to exceed 40 pages, for both its motion for summary judgment and Daubert motion by 6/13/2024, and the Community Care Parties shall file a brief, not to exceed 20 pages, for their Daubert motion; (2) the Community Care Parties shall file an omnibus response, not to exceed 40 pages, by 7/13/2024, and Interim's response to the Community Care Parties' Daubert motion, not to exceed 20 pages, shall be filed by the same date; and (3) Interim's omnibus reply, if any and not to exceed 20 pages, is due by 7/27/2024, and the Community Care Parties' reply, if any and not to exceed 10 pages, is due by the same date.
As a courtesy to the Court, the parties are encouraged not to file their motion papers until the motions have been fully briefed. If the parties follow this practice, the motions and all supporting papers are to be served on the other party along with a cover letter setting forth whom the movant represents and the papers being served. On the day the papers are served, only a copy of the cover letter should be filed on the docket, as a letter, not as a motion. On the day the motions are fully briefed—in this case 7/27/2024—each party shall electronically file its own moving papers.
