Dozens of Blue Cross Blue Shield units are essentially withdrawing their motion to dismiss most or all of an antitrust suit accusing the insurers of curbing competition by divvying the country up between them, saying they realize the motion is likely to be denied after their arguments failed in other cases.

Blue Cross Blue Shield members asked an Alabama federal judge to cull time-barred claims from a major antitrust lawsuit by Bed Bath & Beyond and other corporations, while several members of the insurance network asked to evade altogether a lawsuit they said cannot tie them to the state.
