Sutter Health loses bid to throw out California AG's antitrust lawsuit
( June 10, 2018, 23:28 GMT | Official Statement) -- MLex Summary: Hospital operator Sutter Health can't escape an antitrust lawsuit filed by the California Attorney General for allegedly using its market power to extract above-market rates for healthcare in the region. "Sutter has not established that by entertaining the suit of the Attorney General the court would necessarily be stepping into a role exclusively occupied by the [California Department of Managed Health Care] or otherwise interfere with the agency," San Francisco Superior Court Judge Curtis E.A. Karnow ruled. Karnow also ruled that California can seek disgorgment under the state's antitrust law but can't require mandatory arbitration between Sutter and insurance companies, if it is successful with its lawsuit.See ruling...
