B.C. expands early resolution program for family law cases to five more registries

Law360 Canada (November 6, 2025, 4:43 PM EST) -- British Columbia has expanded access to the Early Resolution Process (ERP) for family law to five additional provincial court family registries in an effort to expand access to fast and affordable family-law dispute resolutions.

The Early Resolution Process provides free, out-of-court support to families on issues such as parenting, support and contact, aiming to reduce conflict and ease pressure on the courts. The ERP will now be available in provincial court family registries in Pemberton, Richmond, Sechelt, North Vancouver and Vancouver (Robson Square).

“Evidence has shown that the Early Resolution Process is providing families the peace of mind that comes with timely resolutions out of court,” B.C. Attorney General Niki Sharma said in a release issued Nov. 6. 

The ERP is already available in Victoria, Surrey, Port Coquitlam, Abbotsford, Chilliwack and New Westminster provincial court family registries.

The province noted that the program has already produced positive outcomes for families.

According to an evaluation, 57 per cent of those who used the service in Surrey resolved their family law issues without going to court. The Surrey courthouse saw a 61 per cent decline in new family law cases as a result.

According to the 2023/24 annual report of the B.C. Provincial Court, family law cases accounted for 33 per cent of the new caseload in provincial courthouses in B.C.

Services under the ERP include screening for family violence, assessing legal and non-legal needs, referrals to community supports, help resolving disputes through consensual processes such as mediation, and guidance in preparing for next steps, including court proceedings, if needed.

“Resolving family disputes out of court reduces toxic conflict, ensures safety and allows families to come to meaningful resolutions that suit their specific needs and circumstances,” said Jennifer Blatherwick, parliamentary secretary for gender equity.
