Law360 Canada ( July 2, 2026, 9:43 AM EDT) -- Appeal by Zurich Insurance Company (“Zurich”) against an appeal judge’s decision. Zurich and Chubb Insurance Company of Canada (“Chubb”) were involved in a dispute over which insurance company was responsible for paying accident benefits for an accident that occurred in 2006 involving Singh. Singh believed Chubb was the insurer. Chubb refused to pay and made no efforts to identify or notify the insurer responsible for coverage. Over a year and a half later, Chubb’s counsel advised Singh’s lawyer that Zurich was the insurer. Zurich started making payments to Singh. However, Zurich took the position that Chubb, as the first insurer Singh notified, should have started adjusting the claim and given notice to Zurich within 90 days. Zurich and Chubb submitted their dispute to arbitration. A second arbitrator decided that Chubb was responsible for paying all benefits to Singh. On appeal, the appeal judge decided that Chubb and Zurich were both insurers and shared responsibility. Zurich submitted that the appeal judge erred in finding that it should be required to pay benefits to Singh.
