A California firm that formerly represented a plaintiff in the NFL's concussion litigation will be shut out of receiving legal fees from a settlement with the league after a Pennsylvania federal judge decided Friday to back a federal magistrate judge's finding that the firm had no reasonable claim to funds.

Blocking Mitnick Law Firm's access to settlement money disbursed from the NFL concussion litigation would impede the firm's ability to process the payments and distribute awards to its clients, according to a recent filing in a federal lawsuit seeking to stop Mitnick from receiving fees from the litigation.

Litigation funder Balanced Bridge Funding LLC says Mitnick Law Office owes it more than $3 million in attorney fees from the NFL concussion settlement and asked a Pennsylvania federal court Thursday to freeze any additional fees likely to be paid out following the removal of controversial race norms in the settlement.

NFL, Concussion Counsel Rebut Race-Norming Concerns
NFL concussion class counsel Chris Seeger of Seeger Weiss LLP, the NFL and two former players struck back at the allegation by a Goldberg Persky & White PC attorney that class counsel breached a fiduciary duty to the class in allowing the controversial use of race-norming to enter the settlement, saying it "ignores the critical fact that race-norming was never required by" the class action settlement.
