The Eighth Circuit on Monday shot down a medical supply company's challenge to the Medicare authority's competitive bidding program for medical equipment, saying that the process is protected from judicial review under the federal legislation governing the system.

A federal judge was wrong to toss a challenge to the Centers for Medicare & Medicaid Services' competitive bidding initiative for buying durable medical equipment after finding that he lacked jurisdiction, according to a brief filed Monday in the Eighth Circuit.
