The Washington State Supreme Court on Thursday said a state law banning malpractice claims after eight years is unconstitutional because it gives some defendants unfair immunity, in a case of a patient who claimed surgery led to a brain injury that went undiagnosed for nearly a decade.

The Washington Supreme Court on Tuesday weighed whether the Evergreen State's eight-year time limit for medical negligence claims is unconstitutional, with one justice noting that the statute on the books was a result of the state Legislature trying to fix problems the high court raised in a previous case.
