A Fifth Circuit panel on Monday partly revived a man's lawsuit against Evonik Corp. and Shell Oil Co. over ethylene oxide emissions from a petrochemical plant in Reserve, Louisiana, that allegedly caused his wife to die from breast cancer two decades ago.

Shell and Evonik Corp. told a Fifth Circuit panel on Tuesday that it would be "ludicrous" to hold former Louisiana chemical plant managers responsible for cancer-causing toxins emissions, arguing that the managers weren't in charge of determining health risks for the nearby area.
