Affinity Physician Network’s password-as-trade secret theory fails in US

By Melissa Ritti ( May 12, 2025, 13:36 GMT | Insight) -- A gender and sex discrimination plaintiff facing trade secret misappropriation counterclaims by Affinity Physician Network and others prevailed Friday when a federal judge in Ohio agreed that her post-termination change of passwords to online services and websites like HubSpot and Instagram is non-actionable. In so ruling, the court said that passwords, alone, lack the independent economic value necessary to rise to the level of a trade secret under Ohio law.A group of defendants accused of sex discrimination and retaliation through their termination of a former employee for Affinity Physician Network saw their sole counterclaim for “theft of computer files/trade secrets” fail on Friday....
