US FTC denied dismissal of Express Scripts' defamation claims

( August 13, 2025, 22:34 GMT | Official Statement) -- MLex Summary: Litigation between Express Scripts and the US Federal Trade Commission pending before the US Court of Appeals for the Eighth Circuit contains "common issues" with a defamation suit brought in Missouri federal court, US District Judge Stephen Clark said in an order denying the FTC's motion to dismiss the Missouri case. Clark denied the FTC's motion without prejudice and stayed the proceedings pending a ruling in the Eighth Circuit case, which relates to the agency's authority to bring antitrust litigation against Express Scripts and other pharmacy benefit managers via the FTC's in-house administrative court. See attached document....
