US Appeals court orders arbitration in BIPA case against dating site

( August 26, 2025, 23:30 GMT | Official Statement) -- An Illinois man must arbitrate privacy claims against a dating service for millionaires after a three-judge panel of the US Court of Appeals for the Ninth Circuit overruled a district judge's order that the "Service Agreement” and “Privacy Policy” links on the site’s signup page were not sufficiently obvious. They write, "In sum, we conclude that the district court erred in denying Millionaire Match’s motion to compel arbitration, because Massel was provided reasonably conspicuous notice of the Service Agreement, to which he assented by checking the box required for account creation and continued use of the website."See attached order....
