South Korea's draft privacy decree clarifies local representative rules for global firms

( May 30, 2025, 06:13 GMT | Official Statement) -- MLex Summary: South Korea’s privacy regulator has unveiled draft amendments to the enforcement decree of the country’s Personal Information Protection Act, aiming to tighten requirements for large overseas service providers and bolster safeguards in the public sector. According to the Personal Information Protection Commission, the proposal — open for public comment from today through July 9 — clarifies when a domestic entity must be designated as a local representative of a foreign company. Specifically, this applies when the foreign business appoints over half of the entity’s executives or holds at least 30 percent of its shares. The draft also spells out oversight duties for foreign companies, including setting and monitoring compliance plans, verifying improvements and conducting annual training. Separately, the decree would expand the definition of public institutions to include local government-funded entities, subjecting them to stricter data protection obligations such as privacy impact assessments and mandatory registration of personal data files.
