South Korea aims to expand data portability right with proposed amendment

( June 23, 2025, 03:43 GMT | Official Statement) -- MLex Summary: South Korea's privacy regulator has announced a draft revision to the Enforcement Decree of the Personal Information Protection Act, or PIPA, to expand the right to data portability. The proposed amendment aims to broaden the applicability of this right beyond the current healthcare and telecommunications sectors, making it more accessible across all sectors. Under the proposal, individuals would be able to request the transfer or download of their personal data from data controllers with annual revenue exceeding 150 billion won ($108 million) and that handle data of more than 1 million individuals. The proposal also clarifies that individuals can download their data directly as encrypted files on websites. It further introduces safeguards for data transfer tools, requiring data controllers to use safer methods such as API-based transfers or pre-agreed methods with data subjects.
