Amazon loses 'dark patterns' expert in approaching trial against US FTC

US District Judge John Chun ruled Rosenberg's opinions on “dark patterns” were “insufficiently reliable” due to a lack of methodological basis. Chun ruled that a second expert for Amazon, Ronald Wilcox, could testify about a consumer survey supporting Amazon’s case, finding his methods to be reliable and widely accepted.In a loss for Amazon before its approaching trial against the US Federal Trade Commission over its alleged use of “dark patterns” design, a federal judge has rejected the company’s expert witness on that topic as “insufficiently reliable.”...
